  2. MICROSOFT AZURE RTOS
  3. Shape
  4. These license terms are an agreement between you and Microsoft Corporation (or
  5. one of its affiliates). They apply to the software named above and any Microsoft
  6. services or software updates (except to the extent such services or updates are
  7. accompanied by new or additional terms, in which case those different terms
  8. apply prospectively and do not alter your or Microsoft’s rights relating to
  9. pre-updated software or services). IF YOU COMPLY WITH THESE LICENSE TERMS, YOU
  10. HAVE THE RIGHTS BELOW. BY USING THE SOFTWARE, YOU ACCEPT THESE TERMS.
  11. INSTALLATION AND USE RIGHTS.
  12. General. You may install and use the software and the included Microsoft
  13. applications solely for internal development, testing and evaluation purposes.
  14. Any distribution or production use requires a separate license as set forth in
  15. Section 2.
  16. Contributions. Microsoft welcomes contributions to this software. In the event
  17. that you make a contribution to this software you will be required to agree to a
  18. Contributor License Agreement (CLA) declaring that you have the right to, and
  19. actually do, grant Microsoft the rights to use your contribution. For details,
  20. visit https://cla.microsoft.com.
  21. Included Microsoft Applications. The software includes other Microsoft
  22. applications which are governed by the licenses embedded in or made available
  23. with those applications.
  24. Third Party Components. The software may include third party components with
  25. separate legal notices or governed by other agreements, as may be described
  26. within the software or in the ThirdPartyNotices file(s) accompanying the
  27. software.
  28. Competitive Benchmarking. If you are a direct competitor, and you access or use
  29. the software for purposes of competitive benchmarking, analysis, or intelligence
  30. gathering, you waive as against Microsoft, its subsidiaries, and its affiliated
  31. companies (including prospectively) any competitive use, access, and
  32. benchmarking test restrictions in the terms governing your software to the
  33. extent your terms of use are, or purport to be, more restrictive than
  34. Microsoft’s terms. If you do not waive any such purported restrictions in the
  35. terms governing your software, you are not allowed to access or use this
  36. software, and will not do so.
  37. DISTRIBUTION AND PRODUCTION USE. If you have obtained and/or are developing on
  38. microprocessor(s) and/or microcontroller(s) (“hardware”) listed in the file
  39. named “LICENSED-HARDWARE.txt” included in the repository and/or distributed with
  40. the software you have the following rights in and to the software solely when
  41. used in combination with the hardware. In the event hardware is not listed in
  42. the LICENSED-HARDWARE.txt file, you do not have the rights in this Section 2.
  43. Distribution and Production Use Rights.
  44. You may use the software in production (e.g. program the modified or unmodified
  45. software to devices you own or control) and distribute (i.e. make available to
  46. third parties) the modified or unmodified binary image produced from this code.
  47. You may permit your device distributors or developers to copy and distribute the
  48. binary image as programmed or to be programmed to your devices.
  49. You may redistribute the unmodified or modified source to your device
  50. distributors or developers. Modifications must be clearly marked. Any
  51. redistribution in source code form must contain this license and any other
  52. licenses that accompany the software.
  53. Requirements. For any code you distribute, you must:
  54. when distributed in binary form, except as embedded in a device, include with
  55. such distribution the terms of this agreement;
  56. when distributed in source code form to distributors or developers of your
  57. devices, include with such distribution the terms of this agreement; and
  58. indemnify, defend and hold harmless Microsoft from any claims, including
  59. attorneys’ fees, related to the distribution or use of your devices, except to
  60. the extent that any claim is based solely on the unmodified software.
  61. Restrictions. You may not:
  62. use or modify the software to create a competing real time operating system
  63. software;
  64. remove any copyright notices or licenses contained in the software;
  65. use Microsoft’s trademarks or trade dress in your application in any way that
  66. suggests your device or application comes from or is endorsed by Microsoft;
  67. transfer individual components, specific libraries, classes, functions or code
  68. fragments of the software separately for purposes unrelated to the software; or
  69. use or distribute the software in any way that would subject the software or
  70. Microsoft’s intellectual property or technology to any other license terms.
  71. SCOPE OF LICENSE. The software is licensed, not sold. Microsoft reserves all
  72. other rights. Unless applicable law gives you more rights despite this
  73. limitation, you will not (and have no right to):
  74. remove, minimize, block, or modify any notices of Microsoft or its suppliers in
  75. the software;
  76. use the software in any way that is against the law or to create or propagate
  77. malware; or
  78. share, publish, distribute, or lease the software (except as permitted in
  79. Section 2 above), or provide the software as a stand-alone offering for others
  80. to use.
  81. DATA. This software may interact with other Microsoft products that collect data
  82. that is transmitted to Microsoft. To learn more about how Microsoft processes

  84. https://go.microsoft.com/fwlink/?LinkId=248681.
  85. EXPORT RESTRICTIONS. You must comply with all domestic and international export
  86. laws and regulations that apply to the software, which include restrictions on
  87. destinations, end users, and end use. For further information on export
  88. restrictions, visit https://aka.ms/exporting.
  89. SUPPORT SERVICES. Microsoft is not obligated under this agreement to provide any
  90. support services for the software. Any support provided is “as is”, “with all
  91. faults”, and without warranty of any kind.
  92. UPDATES. Microsoft may periodically update the software. You may obtain updates
  93. only from Microsoft or Microsoft-authorized sources. Updates may not include or
  94. support all existing software features, services, or peripheral devices.
  95. TERMINATION. Without prejudice to any other rights, Microsoft may terminate this
  96. agreement if you fail to comply with any of its terms or conditions. In such
  97. event, you must destroy all copies of the software and all of its component
  98. parts.
  99. ENTIRE AGREEMENT. This agreement, and any other terms Microsoft may provide for
  100. supplements, updates, or third-party applications, is the entire agreement for
  101. the software. To the extent you have entered into a separate agreement with
  102. Microsoft relating specifically to the software, the terms in such agreement
  103. shall control.
  104. APPLICABLE LAW AND PLACE TO RESOLVE DISPUTES. If you acquired the software in
  105. the United States or Canada, the laws of the state or province where you live
  106. (or, if a business, where your principal place of business is located) govern
  107. the interpretation of this agreement, claims for its breach, and all other
  108. claims (including consumer protection, unfair competition, and tort claims),
  109. regardless of conflict of laws principles. If you acquired the software in any
  110. other country, its laws apply. If U.S. federal jurisdiction exists, you and
  111. Microsoft consent to exclusive jurisdiction and venue in the federal court in
  112. King County, Washington for all disputes heard in court. If not, you and
  113. Microsoft consent to exclusive jurisdiction and venue in the Superior Court of
  114. King County, Washington for all disputes heard in court.
  115. CONSUMER RIGHTS; REGIONAL VARIATIONS. This agreement describes certain legal
  116. rights. You may have other rights, including consumer rights, under the laws of
  117. your state or country. Separate and apart from your relationship with Microsoft,
  118. you may also have rights with respect to the party from which you acquired the
  119. software. This agreement does not change those other rights if the laws of your
  120. state or country do not permit it to do so. For example, if you acquired the
  121. software in one of the below regions, or mandatory country law applies, then the
  122. following provisions apply to you:
  123. Australia. You have statutory guarantees under the Australian Consumer Law and
  124. nothing in this agreement is intended to affect those rights.
  125. Germany and Austria.
  126. i.Warranty. The properly licensed software will perform substantially as
  127. described in any Microsoft materials that accompany the software. However,
  128. Microsoft gives no contractual guarantee in relation to the licensed software.
  129. ii.Limitation of Liability. In case of intentional conduct, gross negligence,
  130. claims based on the Product Liability Act, as well as, in case of death or
  131. personal or physical injury, Microsoft is liable according to the statutory law.
  132. Subject to the foregoing clause ii., Microsoft will only be liable for slight
  133. negligence if Microsoft is in breach of such material contractual obligations,
  134. the fulfillment of which facilitate the due performance of this agreement, the
  135. breach of which would endanger the purpose of this agreement and the compliance
  136. with which a party may constantly trust in (so-called "cardinal obligations").
  137. In other cases of slight negligence, Microsoft will not be liable for slight
  138. negligence.
  139. DISCLAIMER OF WARRANTY. THE SOFTWARE IS LICENSED “AS IS.” YOU BEAR THE RISK OF
  140. USING IT. MICROSOFT GIVES NO EXPRESS WARRANTIES, GUARANTEES, OR CONDITIONS. TO
  141. THE EXTENT PERMITTED UNDER APPLICABLE LAWS, MICROSOFT EXCLUDES ALL IMPLIED
  142. WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
  143. NON-INFRINGEMENT.
  144. LIMITATION ON AND EXCLUSION OF DAMAGES. IF YOU HAVE ANY BASIS FOR RECOVERING
  145. DAMAGES DESPITE THE PRECEDING DISCLAIMER OF WARRANTY, YOU CAN RECOVER FROM
  146. MICROSOFT AND ITS SUPPLIERS ONLY DIRECT DAMAGES UP TO U.S. $5.00. YOU CANNOT
  147. RECOVER ANY OTHER DAMAGES, INCLUDING CONSEQUENTIAL, LOST PROFITS, SPECIAL,
  148. INDIRECT, OR INCIDENTAL DAMAGES.
  149. This limitation applies to (a) anything related to the software, services,
  150. content (including code) on third party Internet sites, or third party
  151. applications; and (b) claims for breach of contract, warranty, guarantee, or
  152. condition; strict liability, negligence, or other tort; or any other claim; in
  153. each case to the extent permitted by applicable law.
  154. It also applies even if Microsoft knew or should have known about the
  155. possibility of the damages. The above limitation or exclusion may not apply to
  156. you because your state, province, or country may not allow the exclusion or
  157. limitation of incidental, consequential, or other damages.
  158. Please note: As this software is distributed in Canada, some of the clauses in
  159. this agreement are provided below in French.

  162. EXONÉRATION DE GARANTIE. Le logiciel visé par une licence est offert « tel quel

  174. Cette limitation concerne:
  175. •tout ce qui est relié au logiciel, aux services ou au contenu (y compris le
  176. code) figurant sur des sites Internet tiers ou dans des programmes tiers; et
  177. •les réclamations au titre de violation de contrat ou de garantie, ou au titre
  178. de responsabilité stricte, de négligence ou d’une autre faute dans la limite

  180. Elle s’applique également, même si Microsoft connaissait ou devrait connaître
  181. l’éventualité d’un tel dommage. Si votre pays n’autorise pas l’exclusion ou la

  183. quelque nature que ce soit, il se peut que la limitation ou l’exclusion

  185. EFFET JURIDIQUE. Le présent contrat décrit certains droits juridiques. Vous
